CCEC Code of Conduct

History

Citywide and Community District Education Council Conduct, Anti-Discrimination and Anti-Harassment Policy and Complaint Procedures (“the regulation” or “D-210”) governs the speech and conduct of the elected and appointed members of the Citywide and Community District Education Councils (“CCECs”) and establishes procedures for the filing and resolution of complaints of violations of this regulation. 

This regulation was amended and issued on December 18, 2025, and supersedes the prior version of the regulation, which was issued on December 22, 2021.  

The regulation’s primary goals are to promote CCEC professionalism; foster and maintain positive, supportive environments for CCEC members; and reinforce New York City Public Schools’ (“NYCPS”) commitment to ensuring school communities are free from discrimination, harassment, bias, racism, and intimidation.

How to file a complaint

Individuals may file complaints alleging violations of Chancellor’s Regulation D-210 by submitting them to the ECO by email, phone, or mail, using the contact information provided below.

Complaints must state the name of the complainant(s) and include a telephone number or email address where they may be contacted.

Complaints should also include the following information, to the extent available:

  1. Identity of the Council Member(s) alleged to have violated this regulation;
  2. A description of the events relating to such alleged violation, including date(s) and location(s),as applicable; and
  3. The provisions of Section IV of D-210 that have been allegedly violated.

Investigative Process 

Equity Compliance Officer Investigation and Report 

The Equity Compliance Officer (“ECO”) is responsible for receiving, responding to, processing, and investigating complaints alleging violations of D-210.

The ECO will review a complaint to determine if it alleges conduct prohibited by D-210. All investigations are conducted confidentially to respect the privacy of the parties and witnesses involved, and retaliation is strictly prohibited. Please note that anonymous complaints will not be accepted.

The ECO will take steps to interview complainants and witnesses, who are encouraged to provide evidence as part of the investigation process. Respondents will have an opportunity to address the allegations before a finding is rendered. If a Respondent chooses not to participate in the investigation, the ECO will make a finding based on the available evidence. Upon completion of the investigation, the ECO will prepare findings and a recommendation as to whether a violation of the regulation has occurred.

Review by the Equity Council 

The "Equity Council," which is comprised of parent leaders from the CCECs and Chancellor’s Parent Advisory Council (“CPAC”), reviews the ECO’s findings and recommendations and may offer its own recommendations to the ECO. In the event of a disagreement between the ECO and the Equity Council, the recommendation of the ECO shall govern.

Chancellor Determination and Conciliation 

The ECO will submit its findings and recommendations to the Chancellor or their designee. Within 10 business days of receiving the ECO's final report, the Chancellor or their designee will issue a written determination regarding whether there has been a violation of the regulation and outline the appropriate corrective or disciplinary action (if applicable), unless circumstances warrant extension of the time period.  

Before any enforcement action is taken, CCEC members subject to such action will have an opportunity for conciliation with the Chancellor or Chancellor’s designee. However, the Chancellor may suspend or remove a Council Member without offering an opportunity for conciliation if the conduct is criminal, poses an immediate danger to the safety or welfare of students or any NYCPS employee, or in the judgment of the Chancellor, is contrary to the best interest of the New York City school district.  

Confidentiality 

It is NYCPS’s policy to respect the privacy of all parties and witnesses regarding complaints made pursuant to this regulation. However, the need for confidentiality must be balanced against the obligation to conduct and cooperate with required investigations, to provide due process to the subject, and/or to take necessary action to conciliate or resolve the complaint. Therefore, information regarding the complaint may need to be disclosed in certain circumstances as appropriate.

Rights under the Regulation 

We respect all participants’ rights throughout this process. The ECO interviews all parties individually and in a private setting. No other parties are permitted to be present during these interviews. 

Respondents are advised of the specific allegations against them at the time of the interview. They can respond to the allegations, provide additional evidence, and identify witnesses at that time. 

The names of the complainant and witnesses are not shared. No recordings of the interview are permitted.  

Both complainants and respondents will be informed of the determination in writing. Witnesses will not be informed of the determination.

Retaliation 

Retaliation is not tolerated under any circumstances. Any complaints of retaliation will be promptly investigated, and appropriate corrective action will be taken.

For all Parties

What happens after I file a D-210 complaint? 

Once you have submitted your D-210 complaint, we will promptly acknowledge receipt of your complaint via email and carefully review your complaint to ensure it alleges conduct that would be prohibited by the regulation. If necessary, we may reach out to you to gather more information or schedule an interview. 

Who conducts the interviews?

The ECO will conduct all interviews.

Am I allowed to bring someone with me to the interview?

No. During the interview, we will ask that you focus on your perspective and experiences without the presence of additional parties. We are protecting confidentiality and the integrity of the investigative process. However, interpretation assistance is available consistent with Chancellor’s Regulation A-663.

Will the ECO inform me of other people who will be interviewed?  

No. To preserve the privacy of the investigation participants, the ECO will not disclose the identity of other interviewees. You may identify witnesses for potential interviews. However, the ECO will determine which individuals may have relevant information and select those who will be interviewed. This information will not be disclosed to any participants of the investigation.  

Will the information I share during the investigation be kept confidential?  

Your information will be treated as confidential, and will only be shared as necessary to conduct a thorough and impartial investigation.  

How long does the investigation take?  

Investigations are generally completed within ninety (90) calendar days of the ECO’s receipt of the complaint unless circumstances warrant extension of the time period.  

 

For the Complainant

Will the ECO inform the respondent that I filed a complaint?  

The ECO does not disclose the identity of complainants. However, it is possible that the respondent may infer the source of the complaint based on the allegations raised.  

While the investigation is ongoing, will I still have to work with the respondent?  

Decisions about whether interventions between the complainant and respondent are appropriate during the investigation will be made on a case-by-case basis.  

Will I find out the outcome of my complaint?  

You will receive notice of the determination of the complaint in writing from the ECO, the Chancellor or designee.  

What should I do if I feel I have been retaliated against for filing a D-210 complaint?  

Retaliation is strictly prohibited. You should report the alleged retaliation to the ECO. Any complaints of retaliation will be promptly investigated, and appropriate action will be taken.  

 

For the Respondent

Will the ECO provide me with a copy of the complaint?  

No, but you will be informed about the allegations in the complaint at the time of the interview, and you will be given an opportunity to respond to them.  

Will the ECO tell me who filed the complaint?  

The identity of the complainant will not be disclosed to you.   

How will I find out the outcome of the complaint?  

You will receive notice of the determination in writing.  

What happens if it is determined that I violated Chancellor’s Regulation D-210?  

You will receive written notice of the determination. If the determination includes corrective or disciplinary action, you will have the opportunity to participate in a conciliation with the Chancellor or the Chancellor’s designee prior to the enforcement of the corrective or disciplinary action. 

 

For Witnesses

Will the ECO identify the complainant?  

The ECO will not identify the complainant, and we request that you refrain from attempting to determine who may have filed the complaint to maintain the confidentiality and integrity of the investigation.  

Will the ECO identify the other interviewees?  

The selection of interviewees is at the discretion of the ECO. You will not be informed about other potential witnesses. We ask that you refrain from discussing the complaint with others to maintain the confidentiality and the integrity of the investigation.   

Will the ECO inform me of the outcome of the complaint?  

To protect the privacy and integrity of the investigation, the ECO will not inform you of the outcome of the complaint. Our commitment to confidentiality extends to all parties involved.
